Filing a warranty claim with your Las Vegas builder is a straightforward process when you know the steps, but it requires documentation and persistence. The most important thing to understand is that nothing in the warranty process should be handled verbally: every communication needs to be in writing.
Step One: Document the Defect Thoroughly
Before submitting anything to your builder, document the problem completely. Take clear photographs from multiple angles and note the date you first observed the issue. If the problem is intermittent, like a door that only sticks in summer or an HVAC noise that only happens at startup, write down when it occurs and under what conditions. Nevada law under NRS Chapter 40 requires builders to respond to construction defect notices within 90 days. If your builder acknowledges your claim but then goes silent on scheduling a repair, follow up in writing and reference your original submission date. Keep copies of all correspondence in a single organized folder, whether physical or digital.
If the builder's repair technician comes to your home, do not sign any paperwork stating the repair is complete unless you have personally verified the fix. Get the repair described in writing and, for significant issues, consider having your independent inspector verify the work before you sign off.
Step Four: Escalate If Necessary
If your builder fails to respond within the required timeframe or refuses to honor a legitimate warranty claim, you have several options in Nevada. You can file a complaint with the Nevada State Contractors Board, which licenses all residential builders and has authority to investigate and discipline contractors. You can also pursue your rights under NRS Chapter 40, which requires a formal notice of defect before legal action but provides a meaningful path to resolution including mediation.
