What Is the Difference Between Expired, Withdrawn, and Canceled?
These terms sound similar, but they carry very different meanings. An expired listing means your agreement ran its full term, typically 3 to 6 months in Nevada, and ended naturally. You owe nothing further to that agent, aside from one important exception.
A withdrawn listing means your home was pulled off the MLS, but the listing agreement is still active. Your agent still represents you. A canceled listing means you and your agent mutually agreed to end the contract early. Each status affects your options differently, so it's important to know which one applies to you.
What Is a Holdover Clause and How Does It Affect You?
Most listing agreements include a holdover clause, also called a protection period. This clause typically lasts 30 to 45 days after your listing expires. During that window, if a buyer who first saw your home during the original listing period submits an offer, your previous agent may still be owed a commission.
This doesn't prevent you from relisting with a new agent. It simply means you should review your original contract carefully and share it with any new agent you're considering. Transparency here avoids potential legal complications down the road.
Can You Relist With a Different Agent Right Away?
Once your listing has truly expired and the holdover period has passed, you are completely free to work with any agent you choose. Even during the holdover window, you can begin interviewing new agents and planning your relisting strategy. You just need to be aware of the clause if a previous buyer comes back.
