Most Las Vegas new construction buyers assume their builder warranty is a broad safety net. The reality is that builder warranties contain significant exclusions, and discovering those gaps after a problem arises can be a costly and frustrating surprise.

Normal Wear and Tear Is Not a Defect

Builder warranties cover defects in materials and workmanship, not items that wear down through everyday use. Paint fading from the intense Las Vegas sun, grout cracking from normal foot traffic, and caulk shrinking around tubs and showers are typically classified as normal wear and are excluded from coverage. These items deteriorate through use, not because they were installed incorrectly.

Nail pops in drywall are another common exclusion after the first year. During the first year of coverage, most builders will address nail pops and minor drywall settling. After that window closes, these are considered a natural result of the home adjusting to its environment and fall outside warranty protection.

Damage You Caused Is Your Responsibility

Any damage resulting from homeowner actions or negligence is excluded from builder warranty coverage. This includes water damage from a hose left running against the foundation, damage from hanging heavy fixtures without proper anchoring, or HVAC problems caused by failure to replace filters on schedule. Builders will inspect repairs carefully and may deny claims if they determine the homeowner contributed to the damage.

Pest damage is also excluded in virtually every builder warranty. Las Vegas has scorpions, termites in certain areas, and other pests that can cause property damage. Builder warranties do not cover infestations or the structural damage that results from them, which is why many new construction buyers choose to add a pest protection plan from a licensed exterminator at closing.

Landscaping and Exterior Features

Most builder warranties exclude landscaping entirely, including sod, plants, trees, and the irrigation systems serving them. In Las Vegas, where xeriscape requirements apply to all new properties under state law, the desert-adapted plants and drip systems installed as standard are typically covered only by a short 30 to 90-day plant warranty from the landscaping subcontractor, not the builder's main warranty.

Concrete flatwork such as driveways and sidewalks is another common exclusion or carries very limited coverage. Minor cracking in concrete is generally considered normal due to Las Vegas soil conditions, thermal expansion in the heat, and the natural curing process.

Appliances and Personal Property

Builder warranties almost never cover appliances beyond the manufacturer's warranty period, which is usually one year. Your refrigerator, range, dishwasher, and microwave each carry their own separate manufacturer warranty. Once those expire, the builder has no obligation to repair or replace them. Similarly, any personal property damaged during a repair is generally not the builder's liability.
