Does Nevada Have a State Income Tax?
No, Nevada does not have a state income tax. The Nevada Constitution, Article 10, Section 1, says no income tax shall be levied on the wages or personal income of natural persons. Because the ban is written into the constitution, removing it would take a vote of the people, not just a new law.
Ryan Rose | Real Broker, LLC is a Las Vegas Realtor who works with buyers moving from states that do tax income. Here is the full answer, including the taxes Nevada does collect.
What Does the Constitution Actually Say?
The key line is in Article 10, Section 1, subsection 9 of the Nevada Constitution. It bars any state tax on the wages or personal income of people. The same subsection says the state may still tax the income or revenue of a business run for profit.
Subsection 7 of the same section adds another rule: no inheritance tax shall ever be levied. So Nevada heirs do not face a state inheritance tax either.
This is not tax advice. Your situation depends on where you earned money and when you moved. Talk with a CPA before you make plans around these rules.
Do I Still Pay Federal Income Tax in Nevada?
Yes. The state ban only covers Nevada taxes. You still file a federal return with the IRS every year, the same as in any other state.
The year you move can be tricky. The state you left may still tax the income you earned while you lived there. A CPA can tell you how your old state handles a move in the middle of the year.
How Does Nevada Collect Money Without an Income Tax?
Sales tax is a big piece. The Nevada Department of Taxation sets a minimum statewide rate of 6.85%, and counties can add more. Clark County's rate is 8.375%, in effect since January 1, 2020. The county's extra pieces pay for things like flood control, regional transportation, the Southern Nevada Water Authority, and police.
The constitution also requires the state to exempt food for human consumption from sales tax. Prepared food for immediate eating and alcohol are left out of that exemption. In plain terms, groceries you cook at home are not taxed, but a restaurant meal is.
Property tax is the other big piece. Clark County applies a 3% cap on the yearly tax bill for an owner occupied primary home. Rentals and commercial property get a cap of up to 8%. A brand new home does not get the cap in its first fiscal year. The cap starts the following year.
What Does No Income Tax Mean for Home Buyers?
For many families, the money that used to go to state income tax can go toward a mortgage. That can change how much home feels comfortable. Still, be careful not to spend all of it. Sales tax on big purchases and HOA dues are real costs here too.
