Las Vegas has seen a real volume of builder complaints in recent years, from crumbling soil issues at Del Webb Lake Las Vegas homes to sinking foundations at Beazer Colton Ranch. Knowing how to protect yourself before and after purchase is one of the most valuable things a new construction buyer can do.
Research Builder Complaint Histories Before You Sign
The time to investigate a builder's complaint record is before you sign a purchase agreement, not after problems surface. The Nevada State Contractors Board maintains a public license lookup at nscb.nv.gov where you can search any builder by name and review their complaint history, disciplinary actions, and license status. The Better Business Bureau, Google Reviews, and community-specific forums on Reddit and Facebook groups for Las Vegas neighborhoods can also surface patterns that official records may not fully capture.
Pay attention to patterns, not just totals. A builder with 15 complaints over 5,000 homes is a very different situation from one with 15 complaints over 200 homes. Look specifically for complaints involving structural issues, warranty non-response, and billing disputes, as those tend to indicate systemic problems rather than isolated incidents.
Document Everything From Day One
Your protection against builder complaints starts with documentation at the very beginning of the construction process. Attend every available milestone walkthrough including the pre-drywall inspection and the blue tape walkthrough before closing. Take photographs and video of every room, every exterior wall, the attic, the crawl spaces, and the garage. Note the date and time on every file.
Submit all warranty claims and repair requests in writing through the builder's official warranty portal or by certified mail. Verbal conversations with sales agents or warranty representatives are difficult to prove and easy to dispute. Written requests with confirmation timestamps create the paper trail that protects you under both NRS Chapter 40 and in any Nevada State Contractors Board complaint proceeding.
Know Your Escalation Options
When a builder is unresponsive to warranty requests, you have three escalation paths available in Nevada. The first is the builder's internal escalation process, which usually means contacting the regional warranty manager or corporate customer relations department above the local team. The second is filing a complaint with the Nevada State Contractors Board, which can result in fines or license action against the builder. The third is pursuing a construction defect claim under NRS Chapter 40, which requires written notice and mediation before litigation.
You do not have to choose just one path. Many Las Vegas homeowners file simultaneously with the NSCB and pursue the NRS Chapter 40 notice process at the same time. The two proceedings are independent of each other, and moving on both tracks can accelerate resolution.
Hire a Third-Party Inspector
One of the most effective ways to protect yourself is to hire an independent licensed home inspector, not the builder's in-house inspector. Third-party inspectors have no relationship with the builder and no incentive to minimize findings. Research shows that 9 out of 10 new construction homes in Las Vegas have at least one significant issue found on inspection. An independent inspection report also serves as powerful evidence if you need to file a warranty claim or escalate a complaint.
